Developer John McKearney, of Connell Place Ltd, submitted a resource consent application to fell the Rosebank Road Pohutukawa, just before Auckland City Council's City Development Committee agreed to immediately start the process to add the Oak and the Pohutukawa at 321 Rosebank Road, Avondale to the list of notable trees in the District Plan. His application, unfortunately, takes precedence.
Under the terms of the legal agreement following The Tree Council's High Court action to stop the felling of the Pohutukawa, The Tree Council has the right to be notified of any subsequent application to fell the Pohutukawa. Auckland City Council has refused to grant full notification (something which The Tree Council considers to be against the rules of their District Plan), but our agreement states that, at a minimum, The Tree Council must be given 'limited notification'. This is what has happened.
